The Acting Commissioners of the CCC
There are a number of functions and duties set out in the Act that can only be exercised by the Commissioner.
The Act however provides that if at any time the Commissioner:
- vacates the office; or
- becomes incapable; or
- is unable to handle any particular case; or
- leaves the state; then
a duly appointed Acting Commissioner can take over and act as Commissioner.
Accordingly, it is clearly necessary that at all times that an Acting Commissioner be appointed and be available in the event of the Commissioner's inability or incapacity otherwise the work of the Commission would grind to a halt.
